How to Register A Trademark in Bangladesh

A trademark is a symbol, design, or phrase that identifies and distinguishes your business from others. Registering a trademark in Bangladesh is an important step in protecting your brand and ensuring that it remains unique to your business. Here is a step-by-step guide on how to register a trademark in Bangladesh.

1.    Conduct a trademark search: Before you begin the process of registering your trademark, it is important to search to ensure that the trademark you wish to register is not already in use or registered by someone else.

2.    Choose the right trademark class: Trademarks are classified into different classes, based on the type of goods or services they represent. You need to choose the correct class for your trademark to ensure that it is registered under the correct category.

3.    Prepare the application: The next step is to fill up the TM-1 form in 80 gsm A4 Paper and submit it with the required documents and prescribed application fee of taka 3500/- to the appropriate trademark office.  The application must include your name and address, the trademark you wish to register, and the class in which you wish to register it. You will also need to provide a detailed description of the goods or services that the trademark will represent.

4.    Examination of the trademark application: The trademark application will next be examined to ensure that it meets all the legal requirements.

5.    Publication of the trademark: If the trademark application has not been objected to after examination, the applied trademark is accepted for Journal publication and TM-5 will be issued to the applicant, inviting the applicant to pay a prescribed fee for the Journal publication. This publication is an opportunity for any parties to object to the registration of the trademark if they believe that it infringes on their rights. If the prescribed fee is paid in due time, the  mark is sent to B.G. Press for printing

6.    Objections and opposition: If any objections are raised within 2(two) months, you will need to respond to them within a specified timeframe. The objections will be reviewed, and a decision will be made whether to grant the trademark registration.

7.    Grant of trademark registration: If the trademark registration is approved, the applicant may pay the prescribed fee to obtain a certificate of registration, which serves as proof of ownership of the trademark.

8.    Renewal of trademark registration: Trademarks must be renewed every 7 years to maintain their validity. You will need to pay the renewal fee and submit a renewal application to the appropriate trademark office.
